New Open Work Permit Option for Provincial Nominee Program (PNP) Candidates

The Immigration, Refugees, and Citizenship Canada (IRCC) has introduced a new temporary policy that makes it easier for some Provincial Nominee Program (PNP) candidates to apply for an Open Work Permit (OWP).

This policy allows eligible newcomers with a job offer, a valid work permit, or those whose work permit expired on or after May 7th, 2024, to apply for an OWP. To qualify, candidates must also provide a support letter from their province or territory, confirming their placement in an Expression of Interest pool or similar application process.

This policy is effective from August 11th, 2024, and will be in place until December 31st, 2024, but IRCC notes that it could be revoked at any time without notice.

Who Is Eligible for This Policy?

To qualify for this Open Work Permit policy, candidates must meet the following criteria under one of these scenarios:

Scenario 1:

  • You have a valid work permit.
  • You’ve applied for a new work permit.
  • You have a support letter from the province/territory confirming your placement in an Expression of Interest pool.
  • You provide a letter of employment from your current employer.

Scenario 2:

  • You had a valid work permit on May 7th, 2024, but it has expired.
  • You’ve applied for a new work permit or to extend/restore your temporary resident status.
  • You have a support letter from the province/territory and a letter of employment from your current employer.

Scenario 3:

  • You were authorized to work under paragraph 186 (u) on May 7th, 2024, and your work permit extension application is pending or approved.
  • You’ve applied for a new work permit and temporary resident extension.
  • You provide a support letter from the province/territory and a letter of employment from your current employer.

Why Has IRCC Introduced This Policy?

The goal of this new policy is to help provinces and territories retain skilled workers who are already living in Canada as temporary residents. By giving them a clearer path to permanent residency, IRCC aims to strengthen Canada’s labor market and retain talent that’s crucial to the economy.
